GiftMe — Terms & Conditions

Welcome to GiftMe. These Terms & Conditions ("Terms") govern your use of the GiftMe website and service ("GiftMe", "we", "us"). By creating an event, making a payment, or otherwise using GiftMe, you ("you", "the host") agree to these Terms. Please read them carefully — you will be asked to confirm that you have read and accepted these Terms before you pay.
1. What GiftMe does
GiftMe lets you create a personalised online wish list for an occasion such as a wedding, baby shower, or birthday. You can customise the look of your page (colours, photos, fonts), add items you would like, and share a link with your guests. Guests can reserve an item so that two people don't buy the same gift. GiftMe does not sell the gifts themselves and does not process payments between guests and you — guests buy items wherever you have linked.
2. Accounts
- You must provide accurate information when you create an account.
- You are responsible for keeping your login details secure and for all activity on your account.
- You must be at least 18 years old, or have the consent of a parent or guardian, to use GiftMe.
3. Pricing and payment
- Publishing an event costs a once-off fee of R100 (one hundred South African Rand) per event.
- The fee is charged through our payment provider, PayFast, at the time you choose to publish.
- The fee is per event, not per account. If you create more than one event, each event requires its own R100 payment.
- Editing an event after it is published — including changing items, photos, colours, or the event date — does not incur a further charge.
4. No refunds
The R100 fee is non-refundable.
Once you have paid and your event is published, the fee cannot be refunded, in whole or in part, for any reason — including if you change your mind, cancel your event, stop using the page, or your event does not go ahead. Please make sure your details are correct before you pay. By paying, you confirm that you understand and accept this no-refund policy.
5. How long your page stays live (expiry)
Your published wish list page does not stay online forever. It automatically expires one (1) month after the event date you choose. After expiry, the public page will show a notice that the wish list has closed, and guests will no longer be able to reserve items. You will still be able to log in and view your dashboard and reservation history (read-only).
Two situations are worth understanding:
If you change your event date after publishing. The expiry date is always calculated as your event date plus one month — it is not a fixed date set once. So if you move your event date, your page's expiry date moves with it automatically. For example, an event dated 10 March would expire on 10 April; if you later change the date to 10 May, the page will instead expire on 10 June. You are not charged again for changing your date — it is simply an edit to an event you have already paid for.
If you publish without choosing an event date. Expiry is normally based on your event date. If you do not set an event date, there is no date to add one month to, so instead your page will expire three (3) months after the date you published it. This makes sure every page always has a clear end date and that no page stays online indefinitely by accident.
If you would like to bring an expired event back online — for example, for a new date — this is treated as publishing again and requires a new R100 payment.
6. Your content
- You are responsible for the content you add to your page, including text, item details, links, and any photos or images you upload.
- You confirm that you own, or have permission to use, any images and other material you upload.
- You must not upload content that is unlawful, offensive, infringes someone else's rights, or contains harmful code.
- We may remove content or suspend an event that we reasonably believe breaches these Terms.
7. Guests and reservations
- Guests do not need an account to view your page or reserve an item.
- Reservation details (such as a guest's name and any message) are collected to run the wish list and are visible to you, the host. By default, other guests do not see who reserved an item.
- GiftMe is not responsible for whether a guest actually purchases a reserved item, or for any dealings between you and your guests.
7a. Cash gifts and EFT
Hosts may offer guests the option to give a cash gift by EFT (bank transfer) instead of, or in addition to, buying an item. If you use this feature:
- GiftMe does not process or hold this money. Any EFT gift is a direct bank transfer between the guest and the host. GiftMe only displays the host's banking details (as entered by the host) and lets guests and hosts mark a gift as sent or received for tracking purposes.
- Hosts are responsible for entering correct banking details and for any tax or other obligations relating to gifts they receive.
- Guests are responsible for verifying details before sending money and send any EFT gift at their own risk.
- GiftMe is not a party to, and not responsible for, any EFT gift, including incorrect details, failed or reversed transfers, or disputes between a guest and a host.
8. Privacy (POPIA)
We process personal information in line with the Protection of Personal Information Act (POPIA). We collect only what is needed to run the service (for example, your account email and guest reservation details). Guests may request removal of their reservation details. 9. Availability and changes
- We aim to keep GiftMe available but do not guarantee uninterrupted service.
- We may update, improve, or change the service, and we may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above.
10. Limitation of liability
To the extent permitted by law, GiftMe is provided "as is". We are not liable for any indirect or consequential loss, or for losses arising from your guests' actions, gifts not being purchased, or your page expiring in line with these Terms. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa.
